Terms of use of the Assistant app

Last updated: October 11, 2026. These terms apply to ERGONOMIA’s “Assistant” iPhone app.

1. What this is about

“Assistant” (the “App”) is an iPhone app published by ERGONOMIA (single-shareholder limited company, trade register Saint-Denis de La Réunion no. 935 284 448, 129 avenue Marcel Hoarau, 97490 Saint-Denis, La Réunion, France). You use it to talk to the executive assistant that we set up for you: by text, by voice, with photos and documents. It is not a separate service: it gives access to your assistant.

2. Who can use it

Access to the App is reserved for ERGONOMIA’s customers, under the contract concluded with them. You link your iPhone to your assistant with a connection code or link provided by ERGONOMIA. The App sells nothing: it offers no purchase or subscription.

3. Apple’s licence agreement

The App is distributed through the App Store. Apple’s standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) applies to the App. These terms of service come in addition; if they conflict on a point covered by Apple’s agreement, Apple’s agreement prevails. Apple is not a party to the contract between you and ERGONOMIA and is not responsible for the App, its content, its support or its maintenance. We do not have a custom licence agreement.

4. What we grant you

ERGONOMIA grants you a personal, non-exclusive, non-transferable right to use the App on the iPhones you use for your business, for the duration of your contract with us. The App, its texts, graphics and code remain the property of ERGONOMIA or its licensors. Your content remains yours.

5. You are talking to an artificial intelligence

  • Your assistant is an AI. When you write or speak to it in the App, you are interacting with an artificial intelligence system, not with a person. The assistant’s voice is AI-generated.
  • It can be wrong. Review before you act or send. Nothing is sent outside (email, message) and no destructive action takes place without your explicit approval.
  • Your requests are passed to an AI provider. To reply, the assistant passes your requests (text, photos, documents, voice) to its AI provider, currently xAI (United States). You are informed of this and you give your agreement on the screen shown at first launch, before signing in. You can withdraw this agreement at any time in Settings › Partage avec l’IA (Sharing with AI); the assistant will then no longer be able to reply in the App. Details (recipients, retention, transfers) are in the privacy policy.
  • Your contacts will know. When the assistant writes or phones another person on your behalf, that person must be told they are dealing with an AI (Article 50 of the EU Artificial Intelligence Act). Do not switch this notice off.

6. Rules of use

You agree to use the App in accordance with the law and the rights of others. In particular, you must not:

  • ask the assistant to produce or send content that is unlawful, deceptive, hateful, harassing or that infringes the rights of others;
  • entrust it with personal data you have no right to use;
  • have it make, on its own, decisions that have legal or significant effects on people (for example sorting job applications or refusing a right): a person must always decide;
  • bypass the protections of the App or the service, disrupt them, or extract their code;
  • share your connection code or give access to someone who is not entitled to it.

You are responsible for your iPhones (passcode, loss, theft). If one is lost, tell us at contact@ergonomia.re: we remove the device’s access. You can also sign out in the App.

7. Reporting content

An assistant message is inaccurate, inappropriate or harmful? In the App, long-press the message, then tap Signaler (Report). You can also write to us at contact@ergonomia.re. We review each report and fix the service where needed. See also Help and contact.

8. Your permissions

The camera, microphone, photos, notifications and Face ID are used only if you allow them, and only for the stated feature. Refusing a permission only limits the feature concerned. You can withdraw them in the iPhone’s Settings › Assistant.

9. Updates

The App can be updated through the App Store and, for fixes, remotely from an ERGONOMIA server, without reinstalling. A version that is too old may stop working; the App tells you so.

10. Suspension

ERGONOMIA may suspend access through the App in case of a serious breach of these terms, after informing you, and without notice in case of an immediate security risk (compromised device, stolen access), for as long as it takes to fix it.

11. Deleting your account

  • In the App: Settings › Supprimer mon compte (Delete my account). Your request is recorded and the deletion is carried out within 30 days at the latest. We confirm when it is done.
  • As a last resort: by email to contact@ergonomia.re, from your account’s email address.
  • Deleting the account erases your data (conversations, files, assistant memory) and closes access through the App. It does not end the contract concluded with ERGONOMIA: to end it, write to us.
  • Invoices and accounting records are kept for the period required by law.

12. Liability

The assistant’s replies are an aid to decision-making: you remain responsible for how you use them and for what you approve and send. ERGONOMIA is liable for its commitments within the limits set by law and by the contract concluded with you. Nothing in these terms limits rights that the law does not allow to be limited.

14. Changes

We may change these terms, for example if the App evolves. Any significant change is announced in the App. The date of the last update is shown at the top of this page.

15. Governing law

These terms are governed by French law. Disputes fall under the competent French courts, without prejudice to the mandatory rules that protect you. The French version prevails in case of doubt.
